Terms of Service

1. Acceptance of Terms

By creating an account or using Woodshedding, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years old to use Woodshedding. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

Free Features

Basic features of Woodshedding are available at no cost.

Premium Subscription

Additional features are available through a paid subscription. Premium subscriptions are billed through the Apple App Store and are subject to Apple's terms and conditions.

• Subscription fees are charged to your Apple ID account
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel your subscription in your Apple ID account settings
• We do not provide refunds for partial subscription periods; refund requests must be directed to Apple

Price Changes

We reserve the right to change subscription pricing. Any price changes will take effect at your next renewal period, and we will provide advance notice of changes.

5. User Content

Your Recordings

Audio recordings you create within the App remain your property. These recordings are stored locally on your device and are not uploaded to our servers.

Practice Data

By using Woodshedding, you grant us permission to store and process your practice session data (duration, type, timestamps) to provide the App's functionality, including cloud sync for premium users.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Share your account credentials with others
• Use the App in any way that could damage or overburden our servers

7. Intellectual Property

The App, including its design, features, graphics, and code, is owned by Woodshedding and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.

8. Disclaimer of Warranties

Woodshedding is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted or error-free
• The App will meet your specific requirements
• Any data stored will be preserved without loss

We are not responsible for any loss of practice data, recordings, or other content.

9. Limitation of Liability

To the maximum extent permitted by law, Woodshedding and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from your use of or inability to use the App.

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $50 CAD, whichever is greater.

10. Termination

By You

You may stop using the App and delete your account at any time through the App settings.

By Us

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Reasons for termination may include violation of these Terms or extended periods of inactivity.

Effect of Termination

Upon termination, your right to use the App ceases immediately. Locally stored data (including audio recordings) will remain on your device. Cloud-synced data may be deleted.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting updated Terms within the App or by email. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

If you do not agree to the updated Terms, you must stop using the App.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through the courts of the Province of Ontario, and you consent to the exclusive jurisdiction of such courts.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Woodshedding regarding the App.
